Between Thanksgiving and Christmas 2008, business at their Allegheny Township company, Alle-Kiski Industries, slowed down significantly. Sales at the machining and welding business were down about 35 percent in 2009 compared to the year before, after increasing steadily since its start in 2005. There were layoffs, pay cuts and sleepless nights for the men, who met while their sons played football together and put everything they had into their venture. "When you put up everything you ever worked for and business starts to drop off, you worry about it," Newell said. The partners weathered the storm. Sales rebounded, and the first quarter of this year was their best ever. On Tuesday, Hartford, 56, and Newell, 51, were showcased as an American manufacturing success story with a visit from Karen Mills, head of the U.S. Small Business Administration. Hartford and Newell got their business started in 2005 with $1.25 million in loans guaranteed by the SBA. A year later, they got another $800,000 SBA loan to buy the building that houses their 27,000-square-foot shop in Allegheny Township. Both men live in Allegheny Township. "We're here in Western Pennsylvania because this is part of the core of American manufacturing," Mills said during a tour of Alle-Kiski Industries. "This is an example of how we at SBA and across the federal government put wind at the backs of American small manufacturing, helping them grow and create jobs." Mills made the visit in advance of one by her boss, President Obama, who will highlight the importance of manufacturing to the U.S. economy during an appearance at Carnegie Mellon University in Pittsburgh on Friday.

Plaintiff is a 50 years old worker and was formerly employed by GlaxoSmithKline as a Senior Executive Sales Representative. Plaintiff is a resident of El Dorado hills California and is currently disabled due to cervical neck pain, cervical degenerative disc disease, cervical spinal stenosis, migraines, chronic back pain, radicular symptoms, decreased range of motion and weakness, adjustment disorder, anxiety and depression. Venue and Jurisdiction of Long Term Disability Lawsuit
Suit was filed in federal court in the Eastern District of California pursuant to 28 U.S.C. § 1331. Specifically, Plaintiff brings this action to enforce plaintiff’s rights under the Employee Retirement Income Security Act ( ERISA ), as allowed by 29 U.S.C. §§ 1132, 1133, & 1140
Allegations of Wrongful Denial of Disability Benefits Under ERISA :
Plaintiff brings this action to secure all long term disability insurance benefits, to which Plaintiff is entitled under a disability insurance policy underwritten and administered by Hartford Life. Plaintiff is covered under the policy by virtue of plaintiff’s employment with GlaxoSmithKline.
The Social Security Administration issued a fully favorable decision on Plaintiff’s claim for social security disability benefits under Title II and Title XVI of the Social Security Act, finding that Plaintiff is “disabled” during the relevant time period, a fact that Hartford Life was aware of.
On October 30, 2008, Hartford Life notified Plaintiff that Defendant affirmed its original decision to deny Plaintiff’s claim for long term disability benefits, totally ignoring the findings of the Social Security Administration.
Hartford Life also notified Plaintiff on October 30, 2008, that Plaintiff had exhausted all administrative remedies and they would consider no further claims or evidence. Hartford Life, in its final denial, discounted the opinions of Plaintiff’s treating physicians, among others, and the documented limitations from which Plaintiff suffers including the effects of Plaintiff’s impairments on plaintiff’s ability to engage in work activities. Plaintiff has now exhausted all available administrative remedies, and plaintiff is forced to file a lawsuit to obtain plaintiff’s rightfully owed disability benefits.
